Fairfax Child and Substance Abuse Attorneys

When a Spouse Alleges Child Abuse During a Divorce

The family law attorneys at the Nova Family Law Group, located in Fairfax, focus our practice on representing clients involved in contentious and high-conflict divorces.

Divorce cases in which one spouse alleges that the other spouse has committed physical or sexual abuse of the child are among the most complex and emotional cases to handle.

Our attorneys are able to provide calm advice and extremely aggressive advocacy on behalf of our clients in these types of divorce cases. Our ability comes from decades of experience handling these types of high-conflict divorces.

Immediate Response Is Necessary When Abuse Is Charged

No matter whether our client is the parent alleging abuse or the parent against whom the charges are made, we take immediate protective action in such cases. As soon as the allegations arise, the tension and conflict level increases dramatically. The accusing spouse is angry about the alleged abuse, and the parent accused with abuse is fearful and defensive because of the very serious consequences that will arise if he or she is found guilty of criminal misconduct.

As soon as allegations of abuse or neglect are made, we begin to coordinate an assessment of the allegations through child psychologists and licensed clinical social workers. It is critically important in these cases for both the parent and the attorney to receive advice from experts in the field of child abuse in order to determine the best course of action.

We work with an array of expert evaluators who work within a model that is neutral, instead of accusatory. We have found in the past that a neutral and well-founded evaluation of the allegations tends to gain more respect from the court than an evaluation that starts from the perspective that the parent is, in fact, guilty.
