The Discovery Process
Three tools are used during the discovery process to obtain all of the necessary financial information: interrogatories (written questions to be answered under oath), deposition (verbal questions to be answered under oath) and production of documents (requests for documents such as income information, tax returns or credit card statements). Through this process, we get a list of all assets, bank and investment accounts, businesses and business interests, real estate holdings and more.
Further Investigation of the Financial Situation
If your spouse fails to provide everything, we may have to dig deeper. Perhaps the information we obtain during the discovery process leads to more questions. Is there income reported that is not accounted for? Is there no indication of where dividends are going? We can subpoena banks and other businesses in order to get financial records and information. In reality, it is extremely difficult to truly hide assets from an attorney with the experience and the tools to get all of the information necessary to produce a fair outcome.
